Terms and Conditions

Last updated: September 21, 2026

These Terms & Conditions govern the use of the Lumsdon North website and the general delivery of our services.

Lumsdon North provides private owner representation, property oversight and project coordination for homes, cottages and recreational properties.

Our role is to give owners a trusted local presence through informed observation, clear reporting, coordination and professional follow-through.

Where a client has entered into a proposal, retainer or service agreement with Lumsdon North, that agreement governs the specific scope, fees, term and responsibilities of the engagement.

1. Our Role

Lumsdon North acts on behalf of property owners within the scope they authorize.

Services may include:

  • property oversight and condition reporting;
  • contractor and vendor coordination;
  • renovation and project oversight;
  • access coordination;
  • progress verification and photographic reporting;
  • maintenance follow-up;
  • seasonal property reviews;
  • support during extended absences; and
  • acquisition, sale, estate or occupancy transitions.

The exact services provided are determined by the applicable client agreement or written instructions.

2. Observation, Not Inspection

Our property visits generally involve observing and documenting conditions that are reasonably visible and accessible at the time of attendance.

They are not comprehensive home inspections, engineering assessments, environmental assessments, code inspections or guarantees of property condition.

Conditions may also change between visits.

Where specialized expertise is required, we may recommend that the owner retain an appropriate qualified professional.

3. Owner Authority

The client remains the decision-maker.

Lumsdon North may communicate with contractors, consultants, insurers, brokers and other parties on the owner’s behalf where required to perform our services.

Unless specifically authorized in writing, we do not have authority to sign contracts, approve major expenditures, settle claims, admit liability or otherwise legally bind the owner.

4. Contractors and Third Parties

Lumsdon North may identify, coordinate or communicate with contractors, trades, consultants and other service providers.

Unless expressly stated otherwise, these parties are independent from Lumsdon North and remain responsible for their own workmanship, professional advice, scheduling, safety practices, licensing, insurance and contractual obligations.

Our coordination or observation of their work does not constitute a warranty or guarantee of that work.

5. Construction and Project Oversight

Where we assist with a renovation, repair or construction project, Lumsdon North acts in an owner-side oversight capacity unless otherwise agreed in writing.

We do not assume the responsibilities of the general contractor, constructor, architect, engineer or other regulated professional.

Contractors remain responsible for construction methods, site safety, permits, code compliance and supervision of their work.

6. Property Access and Security

Clients are responsible for providing lawful and reasonably safe access to the property.

Where keys, access cards, gate codes or alarm information are provided to us, we will take reasonable measures to safeguard them and use them only for authorized purposes.

Lumsdon North is not a security or alarm-monitoring service. Periodic property visits should not be understood as continuous monitoring or surveillance.

7. Urgent Conditions

Lumsdon North is not a 24-hour emergency-response service unless expressly agreed otherwise.

For immediate threats to life or safety, contact 911 or the appropriate emergency service.

Where we become aware of an urgent property condition, we may assist with communication and coordination within the scope of our engagement, but we cannot guarantee a particular response time or outcome.

8. Seasonal and Vacant Properties

Properties can be affected by weather, power interruptions, water conditions, wildlife, mechanical failures and other events occurring between visits.

Our oversight can improve visibility and support timely response, but it cannot eliminate these risks.

Owners remain responsible for maintaining appropriate insurance, alarm systems, monitoring equipment, winterization and preventative maintenance.

9. Fees and Additional Services

Fees, retainers, billing terms and expenses are established in the applicable proposal or service agreement.

Work outside the agreed scope may require additional authorization and may be billed separately.

Third-party contractor, consultant, material and service-provider costs remain the responsibility of the client unless otherwise agreed.

10. Reports and Photographs

Lumsdon North may prepare photographs, notes, reports and other documentation in connection with our services.

These materials are intended to assist the client with property oversight, project coordination and decision-making.

Unless expressly stated otherwise, they are not professional engineering, inspection, appraisal or insurance reports.

11. Privacy

We collect and use only the personal and property information reasonably required to provide our services and administer client relationships.

This may include contact details, property information, access instructions, photographs, correspondence and service records.

Further information is available in our Privacy Policy.

12. Intellectual Property

The Lumsdon North name, branding, website content, reporting formats, templates, checklists and proprietary processes remain the property of Lumsdon North unless otherwise stated.

Clients may use reports and documents prepared specifically for their property for their own personal, property, insurance or professional-advisory purposes.

13. No Guarantee of Outcome

Our commitment is to careful representation, informed observation, communication and follow-through.

We cannot guarantee that:

  • every developing property condition will be visible;
  • damage or equipment failure will not occur;
  • contractors will perform perfectly or on schedule;
  • weather or environmental conditions will remain stable;
  • insurers, municipalities or other third parties will reach a particular decision; or
  • a project will achieve a particular cost, schedule or outcome.
14. Limitation of Liability

Any limitation of liability contained in a signed client agreement will govern.

To the maximum extent permitted by law, Lumsdon North is not responsible for indirect or consequential losses, or for the independent acts or omissions of contractors, consultants, utilities, insurers, municipalities or other third parties.

Nothing in these Terms limits rights or liabilities that cannot legally be excluded or waived.

15. Events Beyond Our Control

We are not responsible for delays caused by circumstances beyond our reasonable control, including severe weather, unsafe access, utility outages, labour disruptions, government restrictions, supply-chain issues or contractor availability.

16. Resolving Concerns

If a concern arises, we encourage clients to raise it promptly so that it can be reviewed and addressed while the relevant information is current.

These Terms and our services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

17. Changes to These Terms

We may update these Terms from time to time.

The current version will be posted on our website with a revised “Last updated” date.

Changes to these website Terms do not override specific contractual rights contained in an existing signed client agreement unless agreed by the parties.
